Official Rules: No Purchase or Payment Necessary to Enter to Win

1. Eligibility: Sanibel Harbour Marriott Resort & Spa BBQ University giveaway is open to legal residents of the United States, its territories/possessions including Canada who are 18 years of age or older at the time of entry and who have an active email account and Internet access. Employees, club members, officers and representatives of Sanibel Harbour Marriott Resort & Spa and each of its affiliated entities, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee or club member are not eligible to participate. Subject to all federal, state and local laws and regulations. Void where prohibited.
2. Agreement to Official Rules: By Participating in the Sanibel Harbour Marriott Resort & Spa BBQ University giveaway, each entrant fully and unconditionally agrees to and accepts these official rules, which are final and binding.
3. Timing: Giveaway begins on May 1, 2009 and ends on August 28, 2009.
4. How to Enter: During the entry period, Contestants will submit their Best BBQ recipe at http://sanibel-resort.com/bbqu/.All entry forms and recipes must be received by August 28, 2009. One (1) winning recipe will be chosen at the end of every month June 1, 2009 (for May entries); July 1, 2009 (for June entries); August 1, 2009 (for July entries); September 1, 2009 (for August entries). Winners will be notified via email. All entries become the exclusive property of Sanibel Harbour Marriott Resort and Spa. Sanibel Harbour Marriott Resort & Spa is not responsible for undeliverable, invalid, illegible or misdirected entry forms, which will be disqualified.
5. Prize Drawing: Entrants need not be present to win. Prize winner will be chosen by Sanibel judges and will occur on or around June 1, July 1, August 1 and September 1. Entrant selected must comply with all terms and conditions of these Official Rules. Winner will be notified by e-mail. Winner must claim and send proof of eligibility within thirty (30) days of being notified. If winner fails to claim and meet requirements by the stipulated time, an alternate entrant will be selected. Odds of winning depend on number of entry forms received.
6. Monthly Prizes:
   One (1) package for two including: Two (2) night stay at Sanibel Harbour Marriott Resort & Spa, waterfront accommodations, breakfast for 2 persons daily (2 days), two welcome cocktails, dinner one night for 2 persons at Courtside Steakhouse. Winning recipe will be featured on the Tarpon House menu (June, July, August, & September), and on Pool Chat. Subject to availability from June 1, 2009 – December 31, 2009. Completed travel must be done by December 31, 2009. Holiday weeks (5 days prior and after) and blackout periods apply. Winner will receive booking instructions. All other expenses are the responsibility of winner. Travel Companion must travel on same itinerary, at the same time and sharing the same room as the winner. No additional persons allowed to stay in the same room as winner and companion.
7. Publicity: Except where prohibited, participation in the Sanibel Vacation Giveaway constitutes winner’s consent to Sanibel Harbour Marriott Resort & Spa’s use of winner’s name, likeness, voice, BBQ recipe, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
8. General Conditions: Sanibel Harbour Marriott Resort & Spa reserves the right to cancel or modify the BBQ University Giveaway if fraud, technical failures or any other factor beyond Sanibel Harbour’s reasonable control impairs the integrity of the giveaway. Sanibel Harbour reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the BBQ University Giveaway or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the BBQ University Giveaway is a violation of criminal and civil law, and, should such an attempt be made, Sanibel Harbour Marriott Resort & Spa reserves the right to seek damages from any such person to the fullest extent permitted by law. Sanibel Harbour’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. Release: By entering this BBQ University Giveaway, entrant agrees to release and hold harmless, Sanibel Harbour Marriott Resort & Spa and all promotional and fulfillment agencies and each of their related companies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the BBQ University Giveaway or receipt or use of any prize. Entrant also agrees to give Sanibel Harbour Marriott Resort & Spa permission to send via e-mail or regular mail information on our hotels, services and offers.
10. Limitations of Liability: in no event shall Sanibel Harbour Marriott Resort & Spa, related companies or their respective officers, directors, or employees be liable for: (i) technical failures of any kind, including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iii) unauthorized human intervention in any part of the entry process; (iv) electronic or human error which may occur in the administration or the processing of entries; (v) any injury, loss, claim, damage, or any special, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, to persons or property, including, but not limited to, entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation or that arise out of or are in any way connected with the use, or the inability to use, the trip site or the services or materials on the site, even if advised of the possibility of such damages. In no event shall the aggregate liability of the sponsors exceed the total charges set forth in the itinerary-giving rise to such liability. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Your use of the site shall be at your own risk.
11. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this giveaway, or any prizes awarded, other than the administration of the giveaway or the determination of winners shall be resolved individually, without resort to any form of class action. (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this BBQ University Giveaway but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of the entrant and trip in connection with the BBQ University Giveaway shall be governed by, and construed in accordance with, the laws of Fort Myers, Florida without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Fort Myers, Florida.
